Booking terms (AGB)

General terms for stays at Cozy Corners and the information we give you before you commit (Allgemeine Geschäftsbedingungen). Last updated 1 October 2026. English first, German version below; both have the same content.

1. Provider and scope

Provider is Cozy Corners GmbH, Eichendorffstraße 3, 92655 Grafenwöhr, Germany (details in the imprint). These terms apply to contracts between us and our guests for the temporary rental of furnished apartments at Eichendorffstraße 3, 92655 Grafenwöhr, from a few nights to many months. Individual agreements in your confirmation take precedence over these terms (§ 305b BGB). Terms of the guest do not apply unless we expressly agree to them in text form.

2. Request and contract

The reservation form, e-mails and calls are non-binding requests; there is no online booking and no instant confirmation. A contract is formed when we confirm your apartment and stay in text form (for example by e-mail) or when you accept our written quote. Our quote or confirmation refers to these terms and states at least the apartment, the period of stay, the number of occupants, the total price with VAT shown, the payment terms, the cancellation conditions and any deposit.

3. Prices and payment

The rate shown on our website (from € 125 per day) is an indication only. The binding total price, with statutory VAT shown, is the one stated in your confirmation. Due dates, payment methods and any deposit are set out in the confirmation. If you travel on orders, tell us in your request; how the stay is billed in that case is also set out in the confirmation.

4. Cancellation, changes and early departure

The conditions for cancellation, changes of dates and early departure are stated in your individual confirmation before you are bound. Statutory rights to terminate for good cause remain unaffected.

5. Use of the apartment and guest registration

The apartment may be used for accommodation of the persons named in the confirmation; the number of occupants must not exceed the number confirmed. Subletting or use for other purposes requires our consent in text form. Please treat the apartment and its furnishings with care and report damage promptly. Liability for damage follows the statutory provisions.

German law obliges us to record a registration form (Meldeschein) for every guest who is not a German citizen (§§ 29, 30 Bundesmeldegesetz). These guests must provide the required details completely and truthfully; see our data protection notice.

6. Liability

We are liable without limitation for intent and gross negligence, for injury to life, body or health, under the Product Liability Act and for guarantees we have given. For slight negligence we are liable only for breach of a cardinal obligation (an obligation whose fulfilment makes proper performance of the contract possible and on which the guest regularly relies), and then limited to the foreseeable damage typical for this kind of contract. Any further liability for slight negligence is excluded. These limits also apply to our legal representatives and vicarious agents. Statutory rights in case of defects remain unaffected.

7. Right of withdrawal

There is no statutory right of withdrawal for contracts on accommodation for purposes other than residential purposes that must be performed on a specified date or within a specified period (§ 312g (2) no. 9 BGB). If a longer stay is legally a residential tenancy, a right of withdrawal may apply under the statutory rules for distance contracts; in that case we give you the legally required instructions together with the confirmation.

8. Dispute resolution

We are neither willing nor obliged to take part in dispute resolution proceedings before a consumer arbitration board (§ 36 VSBG).

9. Applicable law, jurisdiction, severability

German law applies. If you are a consumer, mandatory consumer-protection provisions of the country where you habitually reside remain unaffected (Art. 6 Rome I Regulation). If you are a merchant, a legal entity under public law or a special fund under public law, the place of jurisdiction is Weiden i. d. OPf. Contract languages are English and German. If a provision of these terms is or becomes invalid, the remaining provisions stay in force and the statutory rules replace the invalid one (§ 306 BGB).
